What is an unpaid toll?

Unpaid toll statements can be paid without additional charges within 15 days of the date of issue.
What is an unpaid toll?

In the event that the toll due (art. 176 paragraph 11 of the Italian Traffic Code) is not paid, either in full or in part, a receipt will be issued certifying the non-payment, both in the case of booths with an operator and in the case of automatic ones.

Each ticket (Unpaid Toll Report) contains the report number, the vehicle data (number plate and class), the transit data (date, time, exit toll gate and, where available, also the entry toll gate), the amount to be paid and the method of payment.

Payment deadlines and administration fee:

Non-payment can be paid without charge within 15 days from the date of issue. After this period, the amount will be increased by the administration fees (Art. 176/11 bis of the Italian Traffic Code).

Customers who fail to pay within 15 days of transit will receive a dunning letters by post to the car owner's home address, including the administration fee.

Failure to pay the amount due will result in the forced recovery of the credit with the consequent increase in the costs borne by the debtor (Article 373 of the Italian Traffic Code). In this case, the relevant documents may also be forwarded to the Traffic Police for the subsequent notification of administrative sanctions pursuant to Article 176, paragraphs 11 and 21 of the Italian Traffic Code for ascertained violation of the obligation to pay the motorway toll (which provides for the payment of a sum from € 87.00 to € 344.00 and the deduction of 2 points from the driving licence of the actual offender).

Entry not detected:

If the Non-payment Report bears the wording "ENTRY NOT DETECTED or TICKET MISSING", this means that the entry ticket has not been presented or that transit has taken place in an improper manner with respect to the ticket in his possession or that the entry has not been detected. In this case

the toll is calculated by law from the furthest toll station (art 176/16 of the Italian Traffic Code).

The Customer is entitled to produce proof of the actual tollbooth of entry. Autostrade per l'Italia reserves the right to accept self-certification (pursuant to art. DPR 445/2000) of the entry tollbooth and to carry out subsequent checks on the truthfulness of the declaration.

It is possible to self-certify the toll station by following the instructions on the self-certification page.

REGULATION (EU) 2016/679 and current legislation:

In the event of non-payment, the vehicle's number plate is recorded by photo for subsequent charging to the owner. The data acquired will be processed in accordance with the Regulation. The interested party may exercise its rights under Articles 15-22 of the GDPR, with the right to complain to the Guarantor for the protection of personal data.

Company personnel may be present in the relevant areas (e.g. service areas/motorway toll booths) and in areas outside the motorway section (e.g. ports, interports, customs), in order to inform users about their debt position and facilitate the payment of the relevant "Unpaid Toll Reports".

Video surveillance systems

Information pursuant to art. 13 of European Regulation 2016/679 and to national legislation

The toll booths of Autostrade per l'Italia are equipped with a camera system that automatically records the license plate of transiting vehicles in the event of failure to pay a toll, lack of a ticket or the improper use of toll stations with respect to the relevant ticket in order to carry out the civil, administrative and/or criminal proceedings envisaged under art. 176 of Italian Legislative Decree 285/1992. The pictures of the license plate can only be viewed by the personnel in charge of processing and are stored for the purposes of the collection of the toll and the definition of the proceedings in the event of offences.

The processing of data on the license plate, which is of the common type, and toll collection is carried out pursuant to the provisions of the law.

The pictures of the license plate shall be preserved solely for the time required for the purposes for which they are taken, in compliance with the Minimisation principle under art. 5.1. c) of European Regulation 2016/679, and shall be processed only by persons entitled by the Controller.

The abovementioned data shall be disclosed to third parties (parent/subsidiary companies or third-party companies) required to treat the data for the abovementioned purposes. Said third parties shall be appointed as "processors" for the mentioned purposes; in no case shall said data be disseminated.

The concerned party can exercise the rights under arts. 15-22 of European Regulation 2016/679 by means of an informal request forwarded to the Data Protection Officer at the following PEC e-mail address: dpo@pec.autostrade.it, also by use of specially appointed third parties.

The Controller of the database is Autostrade per l'Italia S.p.A., with registered office in Rome, via A. Bergamini, 50.

EsseDiEsse S.p.A. is responsible for the activities related to the non-payment of tolls.

Data related to the transits in case of Non Payment Report.

Notice pursuant to Art. 13 of the European Regulation No. 2016/679 and to the existing Italian legislation.

In the event that tolls are not paid, in whole or in part, a non-payment report is issued, attesting the non-payment, both in automatic and non-automatic tollgates.

Each transit receipt (Non-Payment Report) includes vehicle's details (number plate and class) and transit details (date, time, motorway tollgate exit and, if available, motorway tollgate entrance and amount to be paid).

These data feed a central database used to perform the resulting civil, administrative and criminal proceedings, where the conditions for their application, provided in Art. 176 of the Legislative Decree 285/1992m are fulfilled.

The above-mentioned data can only be examined by the personnel responsible for this procedure; they are stored for purposes related to the toll payment and, in cases of misdemeanour, to define the procedure to apply.

The processing of the abovementioned data and the toll recovery are carried out as required by law.

They are stored for no longer than the period needed to the purposes for which they were collected and in line with the principle of minimisation provided in Art. 5.1 c) of the European Regulation 2016/679 and will be exclusively processed by the personnel entrusted by the holder.  

Third parties may become aware of the data (subsidiary or parent companies involved). These companies may be entitled to process the data for the abovementioned purposes, and to that end, they may be nominated "Data controllers"; nevertheless, under no circumstances, data will be subject to disclosure.

The data provided by the Customers and those collected by the holder for the actions related to judicial and extrajudicial debt-collection will not be subject to disclosure.

This information may be communicated by Autostrade per l'Italia S.p.A. to third parties, companies and/or practices for assistance operations in debt-collection procedures related to tolls. These companies process information as Holders or Processors designated pursuant to Art. 28 of the European Regulation 2016/679.

In case the information is communicated, for the same purposes, to third parties based outside the EU, specific warranty clauses for the transfer of personal data will be used, pursuant to Art. 46 of the European Regulation 2016/679.

The enumeration of the different categories of persons to whom the data may be forwarded can be required to the Holder, using the following address dpo@pec.autostrade.it.

The data subject may exercise his or her rights pursuant to Articles 15-22 of the European Regulation by submitting an informal request to the following certified mail address dpo@pec.autostrade.it, including through the use of authorized subjects.

The data subject shall have the right to appeal to the Personal Data Protection Authority.
